Without a will, your spouse will receive the first $30,000.00 in value of your estate, plus at least half (50%) of the balance. Your children, if you have any, will receive the other half, in equal shares. This presents problems if you pass without a will and have young children.
If you pass with a will, but leave your spouse less than 33.33% of your estate in your will, your spouse has the right to elect against your will to inherit 33.33% of your estate, regardless of the will’s terms. If your intent is to disinherit a spouse in a second or late in life marriage, in favor of your children, then you will need advanced planning strategies and should seek estate planning counsel, even prior to getting married.
